Conditions relating to the Sale of Goods to you
ALLERSAFE – TERMS AND CONDITIONS

1 Formation

1.1 By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these Terms and Conditions, then you should contact one of our customer service advisors on our freephone number 0800 169 6685 before placing an order with us.

1.2 This website has been designed for use within the United Kingdom and these Terms and Conditions are governed and shall be interpreted in accordance with English law.

1.3 A contract between the customer and Allersafe for the sale of our products will only exist once an order has been received and accepted by us and we send to you confirmation in writing or by email to the address or email address you have given.

1.4 In the event of an increase in the cost to us which is due to any factor beyond our control (such as any foreign exchange fluctuation, currency regulation, alteration of duties, significant increase of costs of labour, material or other costs of manufacture), we reserve the right by giving notice to you at any time before delivery to increase the price to reflect such increase in cost to us. If we give you notice of an increase in the price of Goods, then you shall have the right to cancel, in which case we shall return any deposit paid and you shall be entitled to compensation from us for any reasonable direct loss suffered by you arising from such cancellation.

1.5 We reserve the right to accept or refuse an order. We also reserve the right (without prejudice to any other remedy) to cancel any uncompleted order or to suspend or cancel delivery in the event that you do not meet your commitment to us (including, without limitation, payment for the goods).

1.6 We also reserve the right to make any changes to the specification of the goods which may be required to conform to any applicable safety or other statutory requirements, which do not materially affect their quality or performance.
2 Your Right to Cancel

2.1 Subject to clause 2.3 you have the right to cancel the contract at any time up to the end of seven working days after you receive the goods. A working day is any day other than a Saturday or Sunday or public holiday in England.

2.2 To exercise your right to cancel, you must give us written notice by post or email at the address or email address shown in clause 28, giving details of the goods ordered and (where appropriate) their delivery.

2.3 If you exercise your right to cancel after the goods have been delivered to you, we will arrange for our nominated carrier to collect the goods from you but the cost of this carriage will be charged to you and will be deducted from any refund to you. Goods will only be accepted for return if in a resalable condition, unwashed and with their original packaging. You must take reasonable care to ensure the goods are not damaged in the meantime.

2.4 Once you have notified us that you are cancelling your order, we will refund or recredit you within 30 days any sum that has been paid by you and debited from your credit or debit card for the goods.

2.5 If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods.

3 Return Policy

3.1 Subject to clause 3.2 if you are not entirely satisfied with the goods that you have chosen you have the right to return them to us within 28 days of receipt and you may opt to either receive a full refund or a replacement for the rejected product.

3.2 Items may only be returned, and we will only provide an exchange or refund, provided the goods are returned in a resalable condition, unwashed and with their original packaging.

3.3 To return the goods to us under this clause 3 you must give us written notice by post or email at the address or email address shown in clause 28, giving details of the goods ordered and their delivery.
4 Making Returns

4.1 For all returns we will arrange for our nominated carrier to collect the goods from you. Except where the item is faulty, you will be required to pay for the cost of returning the goods to us. This cost will be charged to you and will be deducted from any refund to you.

4.2 To return the goods pack the items back in the original packaging ready for collection by our nominated carrier.

4.3 Items left for a courier to collect are at your own risk.

4.4 We will only refund the cost of postage where the item returned is faulty.

4.5 Where you have opted to receive a refund the price of the goods returned will not be credited back unless or until they are received by us. Once we are in receipt of the returned goods, unless you have opted to receive a replacement product, we will refund or recredit you within 30 days any sum that has been paid by you and debited from your credit or debit card for the goods.

5 Payment and Taxes

5.1 We accept online payments in a secure environment by credit card. We currently accept Visa, Mastercard, Delta, Solo, Maestro and Switch. Payment can also be made by cheques made payable to Bedeck Ltd.

5.2 All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. The current rate of VAT is 17.5%.

5.3 A delivery charge will be added to your order value where appropriate (see clause 7.4).

6 Our Guarantee To You

We endeavour to display through this website all items in our current range. We aim to hold stock of all styles and sizes whilst a product is active. However, occasionally an item will be out of stock and if this is the case this will be highlighted to you at the earliest possible time and we will indicate an expected due date for delivery. We will endeavour to fulfil your order within 30 days or offer an alternative.

7 Shipment/Delivery

7.1 The goods you order will be delivered to any address within the UK and Ireland you give. For delivery outside of the UK & Ireland please contact one of our customer service advisors for assistance on our freephone number 0800 169 6685.

7.2 If delivery cannot be made to your address we will inform you as soon as possible and refund or recredit you for any sum that has been paid by you or debited from your debit or credit card.
7.3 Every effort will be made to deliver the goods within 4 –5 days after your order has been accepted, and in any event within 30 days of your order. However, we can accept no liabiility for any loss or damage (whether direct or indirect) suffered by you through any reasonable or unavoidable delay in delivery.

7.4 All UK deliveries are subject to a cost of £4.95 per delivery address. Unless requested by the customer, all goods must be signed for at the time delivery is made. The customer, at the time of ordering, may request an alternative delivery address and the goods will be despatched at the customers’ own risk.

7.5 You will become the owner of the goods you ordered and responsible for risk of and loss or damage to them once they have been delivered to you.

8 Description of Goods

8.1 We take every care to ensure that the description and specification of our goods will be as shown on our website at the time you place your order. However, while the colour reproduction is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.
8.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you as soon as possible, and refund or recredit you for any sum that has been paid by you or debited from your credit or debit card.

9 While Allersafe takes all reasonable steps to ensure a fast and reliable service, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss or corruption of any material in transit, or loss or corruption of material or data when downloaded onto any computer system. Further, your access to the website may occasionally be suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services.

10 Allersafe uses reasonable endeavours to ensure that the information on this website is accurate and up to date. Subject to this , it does not give any warranty as to its accuracy or completeness and will not be responsible for any errors or omissions or for the result arising from the use of such information.

11 Further, Allersafe will not be responsible nor liable for your use of any other websites which you may access via links within this website. Allersafe does not control these websites and is not responsible for their content. Any such links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Allersafe.

15 Whilst we will take all reasonable steps to exclude viruses from the website we cannot guarantee such exclusion and no liability is accepted for viruses. You are recommended to take all appropriate safeguards against viruses before accessing the website, its contents and the underlying software and/or related software.

Conditions Relating To Both Your Use Of Allersafe.co.uk and Sale of the Goods to You

16 Allersafe will be responsible for any losses you suffer as a result of us breaching these terms if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. Subject to clause 17 we will not be responsible for any business loss (including , without limitation, loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed.
17 Allersafe does not exclude or limit in any way its liability by law for death or personal injury caused from its negligence or breach of duty or any other liability to the extent that it is illegal to exclude or limit, or to attempt to exclude or limit, such liability.

18 Allersafe will not be liable to you or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.

19 In accordance with the Consumer Transactions (Restrictions on Statements) Order 1976 nothing in these terms shall affect your statutory rights as a consumer.

20 Allersafe may assign or transfer or declare a trust in respect of, any of its rights or sub contract any of its obligations under these Terms and Conditions to or for any third party. You may not assign or transfer, or declare any trust in respect of, any of your rights or sub contract any of your obligations under these terms and conditions except with the specific permission in writing of Allersafe, such permission not to be unreasonably withheld.

21 Should any, or any part of these terms be found by a court or other competent authority to be void or unenforceable such term or part shall be deemed to be deleted from these Terms and Conditions and the remaining Terms and Conditions shall continue in full force and effect.

22 Save as provided in these Terms and Conditions, any notice required or permitted to be given by either of us to the other under these Terms and Conditions shall be in writing in the English language and addressed to us at our trading address shown below and to you at the address given on your order or such other address as may at the relevant time have been notified to the other by giving notice pursuant to this clause. Any notice shall be sufficiently given if sent by first class pre-paid post or by email and shall be deemed delivered (a) in the case of first class pre-paid post, two days after the date of mailing or (b) in the case of email, at the time it was sent if between 9.00am and 5.00pm on a working day and if not at 9.00am on the next following working day.

23 No person who is not a party to these Terms and Conditions shall have any right to enforce any term under the Contracts (Right of Third Parties) Act 1999 (as that Act may be amended, re-enacted or extended from time to time).

24 We reserve the right to modify these Terms and Conditions at any time for any reason.

25 No delay or failure by us to exercise any of our powers, rights and remedies under these Terms and Conditions shall operate as a waiver of them, nor shall any single or partial exercise of any such powers, right or remedies preclude any other or further exercise of them. No waiver by us of any breach of these Terms and Conditions by you shall be considered as a waiver of any subsequent breach of the same or any other provision.

26 These conditions are subject to the laws of England and you agree for our benefit to submit to the exclusive jurisdiction of the English Courts.

27 Use of the website is not authorised in any jurisdiction that does not give effect to any provisions of these Terms and Conditions, including (without limitation) clause 26.
